and Sparrows Point, Md., and firms and sidings located on or connected with its tracks, the charge is 17 cents per ton on iron ore, anthracite, and bituminous coal; 19 cents per ton on coke; and 20 cents per ton on all freight. Similar switching of less-than-carload traffic is at the rate of 3 3/4 cents per 100 pounds.

Switching absorptions.--Each carrier specifies the maximum amounts which it will absorb on certain traffic and the minimum revenue which must not be impaired in any case. Each carrier also specifies the manner in which, and the extent to which, it will absorb the charges of connecting lines. The lack of uniformity in the provisions and limitations of the several carriers precludes a general coverage of the absorption features of the tariffs and, for this reason, representative provisions only are used hereinafter.

The Western Maryland Railway absorbs the switching charges of connecting lines, which are lawfully on file with the Interstate Commerce Commission and the varicus State Commissions, on carload and specified less-carload competitive traffic which it has or will receive, or has had a road haul over its line, when the net revenue from station of origin to destination, after absorption of the switching charge, is $35.86 per car. This absorption applies in connection with the Canton Railroad at Canton, the Pennsylvania Railroad at Hillen, and the Patapsco & Back Rivers Railroad at Sparrows Point. The Western Maryland Railway also absorbs charges of the Pennsylvania Railroad not to exceed $8.86 on all freight originating at or destined to points on or via the Western Maryland at Howardsville, Md., and west thereof, destined to or originating at the following Pennsylvania Railroad stations: Central Avenue, City Block, Jackson's Wharf, and Monument Street. Switching charges not absorbed are added to the line-haul rates. In common with the other railroads at Baltimore, the Western Maryland

Railway absorbs the switching charges of the Canton Railroad of 58 cents per ton, not to exceed $7.08 per car, on all carload and specified less-carload freight when such traffic originates at or is destined to points on connecting lines of the Western Maryland Railway and to and from points on the said railway, except specified Baltimore stations. This company also absorbs the switching charges of the Patapsco & Back Rivers Railroad not to exceed 20 cents per ton on carloads except on iron ore, coal, and coke; an absorption of not to exceed 17 cents per ton on iron ore and coal and 19 cents per ton on coke is provided. However, absorption on carload shipments of coal and coke are not provided when the linehaul rate on these commodities is less than 98 cents or more than $1.06 per ton. On less-than-carload shipments, subject to specified minimum weights, the absorption of switching charges of 3 3/4 cents per 100 pounds, minimum $1.98 per car, is provided. These and the preceding switching absorption charges are under authority of Western Maryland Railway tariff I.C.C. 9054.

The governing provisions and limitations of the other carriers are published in the following tariffs: Pennsylvania Railroad I.C.C.'s 3336 and 3274; Baltimore and Ohio Railroad I.C.C.'s 24051 and C&C 3086; and Canton Railroad I.C.C. 118.

Diversion or Reconsignment

The rail carriers serving the port of Baltimore publish rules and charges tariffs governing diversion and reconsignment of freight and holding cars for surrender of bills of lading, written orders, or inspection. These rules and charges are generally uniform throughout the harbor area. Also, separate charges and provisions are published to cover general merchandise, perishable freight, and coal and coke. Tariff provisions of the Western Maryland Railway I.C.C. 8937, shown in part as follows, may be considered representative.

The term "diversion or reconsignment" means a change in the name of consignee

consignor, destination, route of movement, or any other instructions given by consignor, consignee, or owner necessary to effect delivery and requiring an addition to or a change in billing or an additional movement of the car or both. No Diversion or Reconsignment Charge will be made:

(a) For a single diversion or reconsignment if order for such diversion or reconsignment is received by local freight agent at initial billing point in time to permit instructions to be given to yard employees before car leaves the yard at such initial billing point.

(b) Where a change in route is made necessary by embargo placed against
the billed destination or route thereto subsequent to acceptance of
the car by carrier at point of origin.

(c) Where all charges have been paid to billed destination and delivery
accepted, and a new bill of lading (not an exchange bill of lading)
is issued to a new destination on basis of the rate (not proportion-
al, reshipping, or transshipping rate applicable on traffic origina-
ting beyond the new point of origin) applicable from the new point
of origin shown in the new bill of lading, and without any carrier
or agent of the carrier acting for the shipper. Such transaction
will not be considered as a diversion or reconsignment under these
rules.

(d) When carload shipments consigned to Baltimore, Md., for transshipment
via vessel are ordered for delivery to vessels docked at piers of
the Canton Railroad, and such freight at the election of the owners
is delivered alongside such vessels by carfloat or lighter or to
Canton Railroad for delivery to such vessels.

A request for diversion or reconsignment must be made or confirmed in

writing, and when an order for diversion or reconsignment requires the application of a rate or route which cannot be lawfully applied via the point at which the diversion or reconsignment is made, prompt notice shall be given the party making the request and car will be stopped pending receipt of forwarding orders. Change in Destination:

(a) Only one change in destination at the applicable rate from point of origin to final destination will be permitted by this line under these rules, and then only provided the car has not had a previous change in destination while on the lines of other carriers after leaving the initial billing point.

No diversion or reconsignment charge will be assessed when the combination of tariff rates applicable on a shipment terminating at and on a shipment originating at the point of diversion or reconsignment is applicable to the shipment.

(b) Except as provided, if, after a car has had one change in destination

after leaving the initial billing point, the destination is again
changed upon request of consignor, consignee, or owner, the shipment
will be subject to the tariff rates applicable on a shipment termi-
nating at and on a shipment originating at:

1. The point at which the second or subsequent change in
destination is accomplished; or

2. The point of destination named in the first order
changing the original destination of the shipment,
whichever is lower, plus all charges previously ac-
crued.

(c) If a car which has had one previous change in destination is stopped for
partial unloading at a point intermediate to the billed destination
(either via a publishei tariff route or considered intermediate by
publication in the tariff authorizing stopping in transit to partially
unload) and is there completely unloaded, the transaction will not be
considered as a second change in destination under paragraph (b) of
this rule, but a charge of $12.39 per car will be assessed, plus all
charges previously accrued, and the point of unloading will be con-
sidered the final destination in rating the shipment.

(d) If a car which has had no previous change in destination is stopped at a point intermediate to the billed destination for the purpose of partial unloading, in accordance with tariffs lawfully on file with the Interstate Commerce Commission or State regulatory bodies, and instead of partially unloading the car is completely unloaded, such stop-off point will be considered the final destination of the shipment, and a charge of $5.30 per car will be assessed for the change in the billing incident to the change in the destination of the shipment, plus all applicable charges.

Stopping in Transit.

Except as otherwise provided, if, on request of consignor, consignee, or

owner a car is stopped for orders, for the purpose of delivery or diversion, or for reconsignment or reforwarding prior to the arrival at original billed destina tion, a charge of $5.30 per car will be made for such service and the point where the car is stopped will be considered the original destination of the freight, and notice will be sent, or given, to the party (at the post office address designated by him) on whose order car is held.

Diversion or Reconsignment to Points Outside Switching Limits on Orders Given Before Arrival.

If an order under these rules is placed with the General Freight Office, Western Maryland Railway at Baltimore, Md., or General Manager's Office,

Cumberland & Pennsylvania Railroad at Cumberland, Md., in time to permit instructions to be given yard employees prior to arrival at such billed destination, and the order is accomplished, the through rate will be applied and a charge of $5.30 per car will be made for the service.

Diversion or Reconsignment to Points Outside Switching Limits Before Placement. If a car is diverted or reconsigned on orders placed with local freight agent, or otherwise designated officer, after arrival of the car at billed destination, but before placement for unloading, the through rate will be applied and a charge of $12.39 per car will be made for such service.

If a car has been placed for unloading at original billed destination and

is forwarded therefrom without being unloaded, to a point outside of the switching limits, it will be subject to the published tariff rates applicable on a shipment terminating at and on a shipment originating at the point of diversion

or reconsignment.

Diversion or Reconsignment to Point Within Switching Limits Before Placement.

A single change in the name of consignor and/or consignee and/or a single change in or a single addition to the designation of place of delivery at desination will be made on basis of the through rate under the following conditions:

1. When order is placed with local freight agent or other authorized representative of the road haul delivering carrier at destination direct by consignee or owner:

Per car

(a) Prior to arrival of car at destination in time to
permit instructions to be given to yard employees.. No charge
(b) After arrival at destination but prior to expira-

tion of 24 hours after first 7 a.m. after the day
on which notice of arrival is sent or given con-
signee or party entitled to receive same..

(c) After expiration of 24 hours after the first 7 a. m.
after the day on which notice of arrival is sent
or given consignee or party entitled to receive

same.
