AN ACT

For the relief of Mrs. Harriet Gantt.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That the sum of three hundred and thirty eight dollars and forty-three cents be and the same hereby is appropriated out of any money in the treasury not otherwise appropriated to pay the claims of Mrs. Harriet Gantt, widow of the late chief justice, for services rendered by her said husband.

SEC. 2. The auditor of public accounts is hereby authorized, upon the presentation of proper vouchers, to draw his warrant on the state treasury in favor of Mrs. Harriet Gantt for the amount herein appropriated.

SEC. 3. Whereas an emergency exists, therefore, be it enacted that this act shall take effect and be in force from and after its passage.

Preamble.

AN ACT

For the relief of Thomas L. Griffey and E. K. Valentine.

WHEREAS, Thomas L. Griffey was by the state board of canvassers declared elected judge of the sixth judicial district; and they having issued to him a certificate of election to said office, he entered upon and discharged the duties of said office from the 6th day of January, until the 23d day of November, 1876, at which time he

was ousted from said office by reason of a decision of the supreme court declaring E. K. Valentine duly elected to said office; and

WHEREAS, The said E. K. Valentine, by reason of said decision is entitled to the emoluments of said office during all of the said time, and the said Griffey having drawn the salary of said office for the first (1st), second (2d), and third (3d) quarters of said year, and said E. K. Valentine having drawn no part thereof; and

WHEREAS, The said Thomas L. Griffey having performed the duties of said office from October 1st, until November 23d, 1876, under said certificate of election without pay; therefore,

Be it enacted by the Legislature of the State of Nebraska :

AN ACT

For the relief of Adolph Coppam.

WHEREAS, In the year 1875 appraisers were appointed to appraise the school lands of this state, in the county of Furnas, as provided in section 8, page 992, of the general statutes, and

WHEREAS, Said appraisers could not appraise said lands for the reason that the government survey of the same lands was so defective that the said lands could not be found; and,

WHEREAS, The board of county commissioners of said connty thereupon appointed said Adolph Coppam county surveyor of said county to survey the same (forty sections in all), and which lands so surveyed were appraised, and his claim therefor, including all expenses of said survey, and amounting to one thousand and seventy-six dollars, was, by said board of county commissioners on the 20th day of April, A.D. 1876, duly audited and certified as provided by section 5, page 998, General Statutes, and which claim has never been paid, and

WHEREAS, Said Furnas county and State of Nebraska has since and now is using said appraisement and survey and the field notes of said survey; therefore,

Be it enacted by the Legislature of the State of Nebraska :

SECTION 1. That there is hereby appropriated out of any money in the treasury of the State of Nebraska, not otherwise appropriated, the sum of one thousand and seventy-six dollars for the payment of said claims. SEC. 2. The auditor of public accounts is hereby authorized and directed to draw his warrant upon the state

treasurer for the sum of one thousand and seventy-six dollars in favor of said Adolph Coppam for the payment of said claim.

AN ACT

For the relief of John Gillespie..

WHEREAS, The state obtained a judgment against Preamble. John Gillespie for the sum of ten thousand ($10,000) dollars for expenditures made while auditor of the state; and

WHEREAS, Said expenditures were incurred in securing to the State of Nebraska the agricultural college lands, internal improvement lands, indemnity school lands, and expenses in the sale of common school lands, the expenses of the insane asylum, and securing other material interests of the state, and the state having received the benefits thereof; and

WHEREAS, The proper vouchers are on file in the auditor's office in support of such expenditures and the amounts charged against the several appropriations made for such expenses; therefore,

Be it enacted by the Legislature of the state of Nebraska:

That the attorney general is required and hereby au- Relief granted. thorized to cause the aforesaid judgment to be canceled

and discharged of record.

Property donated to Ne

school purposes

AN ACT

To transfer the building and grounds therewith known as the Christian Church, on the corner of Laramie and Sixth streets, in Nebraska City, to the corporation of Nebraska City for school purposes.

WHEREAS, Heretofore there was school money of the state of Nebraska loaned to the trustees of the Christian Church building, situated on lots, and on the northwest corner of block six, of Nebraska City proper, in Otoe county, Nebraska, and a mortgage was given to secure such money, and upon a foreclosure of such mortgage the state became the owner of such church building; and

WHEREAS, Such building is of no benefit to the state, and requires an expenditure of money to keep the building safe and of any value; and

WHEREAS, Nebraska City has built and paid for the school buildings of said city without using school money therefor; therefore

Be it enacted by the Legislature of the state of Nebraska:

That there is hereby donated to Nebraska City the braska City for said church building, and the ground therewith, for school purposes, to be used and controlled as other common school property of said city is controlled. The Governor of Nebraska is hereby authorized and required, in behalf of the state, to execute a full and complete conveyance of said property to Nebraska City, for the purposes mentioned, by May 1, A.D. 1879, it being the intention that such property be donated to the use and benefit of common schools of Nebraska City.
