presented to the auditor he shall draw his warrant on the general fund in favor of the contractor for eighty per cent of the amount certified to by the board, and when the contract is completed and the final estimate made the board shall certify this fact to the auditor, who shall then draw his warrant for the balance due on the contract: Provided, That the whole amount paid out under the provisions of this act, including cost of advertising, plans, architect, builder, and every other expenditure under and by the provisions of this act, shall not exceed in the aggregate the sum of seventy-five thou sand dollars; and, provided further, That each person or firm to whom any such payment may be made shall accept the same as payment in full of any and all contracts made or liabilities incurred by or in behalf of the state under any of the provisions of this act, and shall execute a release in writing of all claim against the state on account of any and all services rendered, or material furnished, on account of said building, or under the provisions of this act.

SEC. 11. It shall be the duty of the treasurer to pay said warrants when presented, whenever there are sufficient funds in his hands belonging to the general fund. Approved February 25, A.D. 1879.

Making an appropriation for the erection of two wings to the hospital for the Insane, and other improvements.

Be it enacted by the Legislature of the State of Nebraska:

Seven hundred dollars in fencing, three hundred dollars in fruit and ornamental trees, and the improvement of the grounds.

SEC. 2. SEC. 3. The board of public lands and buildings shall, on adoption of plans and specifications, advertise in two newspapers, one in the city of Omaha and one in the city of Lincoln, for thirty days, for bids for the erection of the said wings in accordance with the plans and specifications adopted. The board shall, on the day named in said advertisement, open the bids and award the contract to the lowest and best bidder for the interests of the state, the board reserving the right to reject any and all bids. In the event all of the bids shall be rejected, the board shall immediately advertise again, same as before, and continue to so advertise until said contract shall be awarded.

SEC. 4. Immediately upon the awarding the contract, the board shall appoint a competent, practical builder as superintendent of construction, whose duty it shall be to see that the plans and specifications adopted by the board are faithfully carried out by the contractor. And it is hereby made the duty of the superintendent to see that the material used in the construction of and work done upon said building shall in all respects conform to the plans and specifications. It shall be the duty of the superintendent to make and return to the board monthly estimates of the work done, which stateCompensation. ments shall be sworn to. The superintendent shall be allowed not exceeding four dollars per day so employed.

SEC. 5. The contractor, before entering on the execution of the contract shall execute a bond to the state of Nebraska in the penal sum of twice the amount of the contract price for the erection of said improvement, with good and sufficient sureties, to be approved by the board, conditioned for the faithful performance of the contract in all respects.

SEC. 6. The contract shall provide for the completion of said building, by the first day of January, 1880. During the progress of the construction of said build

AN ACT

To provide for the payment of the indebtedness of the model farm of the state University; to direct the regents thereof to cover into state treasury all securities and moneys in their possession on account of sales of the two sections of saline land, set apart for a model farm, and to repeal an act entitled "An act to provide for the sale of lands set apart for a model farm."

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That the sum of eight thousand dollars, or so much thereof as may be necessary, be and the same is hereby appropriated out of any moneys in the state treasury, not otherwise disposed of, for the payment of the remaining indebtedness of the model farm of the state university, to be drawn by the regents thereof upon the warrant of the auditor of public ac

counts.

SEC. 2. And the regents aforesaid, shall within thirty days after the taking effect of this act, transmit to the state treasury all moneys or evidences of indebtedness arising from the sale of any lands set apart for the purposes of a model farm.

SEC. 3. Sections one, two, three and four of an act entitled "An act to provide for the sale of lands set apart for a model farm," approved February 20, 1875, be and the same are hereby repealed.
