All such subpenas shall be issued and signed by 2 the Comptroller General. 3 (B) In case of a refusal to comply with a subpena 4 issued under subparagraph (A) 5 6 7 8 9 10 11 (i) the Comptroller General is authorized to seek an order by any district court of the United States having jurisdiction of the defendant to require the production of the documents involved; and (ii) such district court may issue such order and enforce it by contempt proceedings. RECOMMENDATION ON FINANCIAL CONFLICTS OF INTEREST 12 SEC. 8. The Civil Service Commission and the Depart 13 ment of Justice shall each analyze regulations and proce14 dures presently in effect with regard to financial conflicts 15 16 of interest among employees of the Federal Government and recommend to the appropriate committees of Congress for 17 their consideration such legislation as may be necessary. 18 Such reports shall be delivered within six months of the 19 enactment of this Act. 20 225 21 SEPARABILITY SEC. 9. If any part of this Act is held invalid, the 22 remainder of this Act shall not be affected thereby. If any 23 provision of any part of this Act, or the application thereof 24 to any person or circumstance, is held invalid, the provisions 25 of other parts and their application to other persons or 26 circumstances shall not be affected thereby. 1 18 AUTHORIZATION OF APPROPRIATIONS 2 SEC. 10. (a) Upon assuming the position of an officer 9 or employee designated in subsection (f), an individual 10 shall file a report as required by subsection 102 (b). 11 I (b) Upon the transmittal by the President to the 2 1 Senate of the nomination of an individual to a position, 2 appointment to which requires the advice and consent of 3 the Senate, such individual shall file a report as required 4 by subsection 102 (b). 5 (c) Upon becoming a candidate for nomination or 6 election to the office of President or Vice President, as 7 determined by the Federal Election Commission, an in8 dividual shall file a report as required by subsection 102 (b). 9 (d) Any individual who is an officer or employee 10 designated in subsection (f) during any calendar year and 11 performs the duties of his position or office for a period in 12 excess of sixty days in that calendar year shall file on or 13 before May 15 of the succeeding year a report as required 14 by subsection 102 (a). 15 (e) Any individual who occupies a position designated 16 in subsection (f), before leaving such position, shall file 17 a report as required by subsection 102 (a), unless such 18 individual has accepted employment in another position 19 designated in subsection (f). 20 (f) The officers and employees referred to in subsec 21 tions (a), (d), and (e) are (1) the President; (2) the Vice President; (3) each officer or employee of an executive agency, as defined in section 105 of title 5, United 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 States Code, including a special Government employee as defined in section 202 of title 18, United States Code, whose pay rate either is specified in subchapter II of chapter 53 of title 5, United States Code, or is at a comparable or greater pay rate under another authority; and (4) each officer or employee, including a special Government employee as defined in section 202 of title 18, United States Code, whose position is classified at GS-16, GS-17, or GS-18 of the General Schedule prescribed by section 5332 of title 5, United States Code, or who is in a comparable position under another authority; each member of a uniformed service whose pay grade is at or in excess of 0-7 under section 1009 of title 37, United States Code; and each officer or employee in any other position determined to be of equal classification.
