R. 4453 IN THE HOUSE OF REPRESENTATIVES March 3, 1977 Mr. Rodino introduced the following bill; which was referred to the Com mittee on the Judiciary A BILL To require the President, the Vice President, Justices and judges and officers and employees of the United States to file statements with designated officers and the Civil Service Commission with respect to their income and financial transactions. 1 Be it enacted by the Senate and House of Representa 2 tives of the United States of America in Congress assembled, 4 SECTION 1. This Act may be cited as the "Financial 7 SEC. 2. The provisions of this Act are deemed necessary 8 and relevant to protect the integrity and effective functioning 9 of the Federal Government in all of its branches. It is recog I 2 i nized that there must be a balance between the Government's 2 need for the disclosure of such information as required by this 3 Act, and the individual's right to personal privacy, and that 7 (1) the term "agency" means each authority of the 9 10 (2) the term “administering officer” means the head of an executive agency, the Secretary of the Senate, the Clerk of the House of Representatives, the Director of the Administrative Office of the United States 11 12 13 Courts, and the Chairman of the Civil Service Com 15 16 17 (3) the term “commodity future” has the meaning set forth in sections 2 and 5 of the Commodity Exchange Act, as amended (7 U.S.C. 2 and 5); (4) the term "candidate” has the meaning set forth in section 301 of the Federal Election Campaign Act of 18 19 20 1971 (2 U.S.C. 431); 21 (5) the term “Comptroller General” means the Comptroller General of the United States; 22 23 (6) the term “dependent” has the meaning set 24 forth in section 152 of the Internal Revenue Code of 3 1 2 (7) the term "employee” includes, for purposes of section 4, any employee designated under section 2105 of title 5, United States Code, any employee of the 3 4 United States Postal Service or of the Postal Rate Com 5 mission and special Government employees as defined 6 in section 202 of title 18 of the United States Code who 8 (8) the term "immediate family" means the spouse 9 of an individual and those blood relations of an indi 10 vidual or of the spouse of such individual who are resi 12 (9) the term "income” means gross income as 13 defined in section 61 of the Internal Revenue Code of 15 (10) the term "Member of Congress” means a 16 Senator, a Representative, a Resident Commissioner, or 17 18 a Delegate; (11) the term "officer” includes, for purposes of section 4, any officer designated under section 2104 of title 5, United States Code, and any officer of the (12) the term “Presidential nominee” means an individual appointed by the President to an office for which confirmation, by and with the advice and consent 25 4 1 of the Senate, is required, or an individual nominated 2 by the President to serve as Vice President pursuant to 3 the twenty-fifth amendment to the Constitution of the 5 (13) the term “political contribution" means a 6 contribution as defined in section 301 of the Federal 7 8 9 Election Campaign Act of 1971 (2 U.S.C. 431); (14) the term “political expenditure" means an expenditure as defined in section 301 of the Federal Election Campaign Act of 1971 (2 U.S.C. 431); (15) the term "security” has the meaning set forth in section 2 of the Securities Act of 1933, as amended 10 11 12 13 (15 U.S.C. 77b); 14 (16) the term “transactions in securities and com 15 16 modities” means any acquisition, transfer, or other dis- of the Armed Forces, the commissioned corps of the Pub 17 18 19 lic Health Service, or the commissioned corps of the 20 National Oceanic and Atmospheric Administration. 21 INDIVIDUALS REQUIRED TO FILE REPORT 22 Sec. 4. (a) Any individual identified in subsection (b) 23 shall file each calendar year a report containing a full and 24 complete financial statement for the preceding calendar year 5 1 if such individual has occupied or been a candidate for the 2 office or position for a period in excess of ninety days in such 3 calendar year. 4 5 (b) The individuals referred to in subsection (a) are (1) the President and any candidate for that Office; (2) the Vice President and any candidate for that Office; 8 (3) each Member of Congress and any candidate 10 (4) each justice or judge of the United States; 11 12 13 (6) each officer or employee of the United States who is compensated at a rate equal to or in excess of the minimum rate prescribed for employees holding the grade of GS-16 of the General Schedule or any higher 14 15 16 17 18 grade or position. (7) each member of a uniformed service who is compensated at a rate equal to or in excess of the monthly rate of pay prescribed for grade 0–7 or any higher grade of pay established under chapter 3 of title 37, 19 20 21 United States Code. 22 23 (8) such other member of a uniformed service, officer or employee as may be determined to be necessary by the administering officer. 24 |
