A BILL

To require the President, the Vice President, justices, and

judges and officers and employees of the United States to file statements with designated officers and the Civil Service Commission with respect to their income and financial transactions.

1. Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That this Act may be cited as the “Financial Disclosure

Sec. 2. The provisions of this Act are deemed necessary

7 and relevant to protect the integrity and effeotive funtioning

8 of the Federal Government in all of its branches. It is rec

9 ognized that there must be a balance between the Govern

1 ment's need for the disclosure of such information as required 2 by this Act, and the individual's right to personal privacy, 3 and that such balance is served by this Act.

(1) the term “agency” means each authority of

the Government of the United States;

(2) the term “administering officer” means the

9

head of an executive agency, the Secretary of the Sen

10

ate, the Clerk of the House of Representatives, the Di

11

rector of the Administrative Office of the United States

12

Courts, and the Chairman of the Civil Service Com

(3) the term "commodity future” has the meaning set forth in sections 2 and 5 of the Commodity

15

Exchange Act, as amended (7 U.S.C. 2 and 5);

(4) the term “candidate” has the meaning set forth in section 301 of the Federal Election Campaign

(5) the term “Comptroller General” means the Comptroller General of the United States;

(6) the term “dependent” has the meaning set

23

forth in section 152 of the Internal Revenue Code of

(7) the term "employee” includes, for purposes of

section 4, any employee designated under section 2105

2

of title 5, United States Code,' any employee of the

United States Postal Service or of the Postal Rate Com

4

mission and special Government employees as defined

5

in section 202 of title 18 of the United States Code who

6

are employed in the executive branch;

(8) the term “immediate family” means the spouse of any individual and those blood relations of an individual or of the spouse of such individual who are residents

of the individual's household;

(9) the term “income” means gross income as de

12

fined in section 61 of the Internal Revenue Code of

(10) the term “Member of Congress” means a

Senator, a Representative, a Resident Commissioner, or

16

a Delegate;

(11) the term "officer” includes, for purposes of

17

section 4, any officer designated under section 2104 of title 5, United States Code, and any officer of the

(12) the term "Presidential nominee” means an

individual appointed by the President to an office for

24

which confirmation, by and with the advice and con

25

sent of the Senate, is required, or an individual nomi

nated by the President to serve as Vice President pursuant to the twenty-fifth amendment to the Constitution

of the United States;

: (13) the term “political contribution” means a

contribution as defined in section 301 of the Federal

6

Election Campaign Act of 1971 (2 U.S.C. 431) ;

(14) the term “political expenditure” means an

expenditure as defined in section 301 of the Federal

9

10

Election Campaign Act of 1971 (2 U.S.C. 431);

(15) the term "seourity” has the meaning set forth in section 2 of the Securities Act of 1933, as

11

amended (15 U.S.C. 77b);

(16) the term “transactions in securities and commodities” means any acquisition, transfer, or other disposition involving any security or commodity; and

(17) the term “uniformed services” means any of the Armed Forces, the commissioned corps of the Public

Health Service, or the commissioned corps of the National Oceanic and Atmospheric Administration.

INDIVIDUAL REQUIRED TO FILE REPORT

21 SEC. 4. (a) Any individual identified in subsection (b) 22 shall file each calendar year a report containing a full and 23 complete financial statement for the preceding calendar year 24 if such individual has occupied or been a candidate for the
