Mr. Wood. Yes, Mr. Chairman.

Mr. SLACK. Please proceed.

GENERAL STATEMENT

Mr. WOOD. Mr. Chairman and members of the subcommittee, I appreciate the opportunity to appear in support of the Civil Division's supplemental budget request of 30 positions and $425,000 for our Economic Stabilization Section for fiscal year 1973. The supplemental request together with the 10 positions and $248,000 which have been authorized for fiscal 1973 will provide a total of 40 positions and $673,000 with which to operate the section this fiscal year.

Forty positions were funded in phases throughout fiscal 1972 in order to provide immediate manpower in the Civil Division for the stabilization program. We believe we can carry out our responsibilities under the program in fiscal 1973 at the 1972 position level.

As you know, the Economic Stabilization Section was established in November of 1971 and was given the responsibility for handling all litigation involving the Government and its instrumentalities occurring in or related to the President's economic stabilization program. New cases arising under the program have increased from a rate initially projected of 100 per month to an average of 225 per month. Several factors are causing this increased workload: The expansion of the client agencies in the program with the concomitant increase in the number of cases being referred for litigation, the increasing complexity of the investigations the section must review, and the need to render greater assistance to the client agencies.

Due to the critical situation in the Civil Division with respect to the mounting backlog of cases exclusive of the Economic Stabilization Section, the Civil Division cannot divert positions and resources from other sections of the division without seriously hampering the effective operation of those sections. It was because of this workload that emergency funding was provided in fiscal 1972 for the stabilization program and why funding must be continued for fiscal 1973.

For these reasons, Mr. Chairman, we strongly recommend favorable consideration of this supplemental request.

Mr. SLACK. How many positions do you have authorized for General Legal Activities?

Mr. KAMINSKI. Mr. Chairman, I am sorry I didn't bring that with me. It is in the neighborhood of 2300.

Mr. POMMERENING. Is the question relative to the entire appropri

ation?

Mr. SLACK. Yes.

Mr. POMMERENING. 2303 I believe are the authorized positions. Mr. SLACK. How many vacancies do you have at the present time? Mr. POMMERENING. Our vacancies are somewhat less than the number shown on the document which you have. That indicates that there were approximately 322 vacancies. They are not that high at this time.

They are running in the neighborhood of 175, split between the eight legal divisions that are part of this appropriation.

Mr. SLACK. How many new positions were you allowed for the current fiscal year?

Mr. POMMERENING. I believe it was 205.

Mr. KAMINSKI. Yes.

ADDITIONAL POSITIONS REQUESTED

Mr. SLACK. How many additional positions are you requesting? Mr. POMMERENING. This request is for 30 positions.

Mr. SLACK. How many positions did you have on this program in fiscal year 1972?

Mr. Wood. 40 positions, Mr. Chairman.

Mr. SLACK. How were those positions funded?

Mr. POMMERENING. There were 40 positions, as Mr. Wood said, funded for this purpose in fiscal year 1972. Ten of those positions were funded in the base of the Civil Division by diversion of resources. The other 30 were funded by funds made available to the Department through the Office of Management and Budget by transfer of funds available to the Cost of Living Council.
