Operation by applicant as a contract carrier by motor vehicle of class A and class B explosives and certain related commodities from a plant site near Carthage, Mo., to points in Jefferson and Shelby Counties, Ky., over irregular routes, found not shown to be consistent with the public interest and the national transportation policy. Application denied.

BY DIVISION 1:

Exceptions to the order recommended by the joint board were filed by protestant, and applicant replied. Our conclusions differ from those recommended.

By application filed June 18, 1959, as amended, H. Messick, Inc., of Joplin, Mo., seeks a permit authorizing operation, in interstate or foreign commerce, as a contract carrier by motor vehicle, over irregular routes, of class A and class B explosives and blasting agents, supplies, and materials from the plant site of the Hercules Powder Co., located near Carthage, Mo., to points in Jefferson and Shelby Counties, Ky., restricted against the performance of any transportation service for the U.S. Government or any of its agencies. Baggett Transportation Company opposes the application. The opposition of Best Way of Indiana, Inc., was withdrawn upon amendment of the application to its present form.

The joint board recommended that the application be granted. On exceptions protestant contends that its refusal to provide a trailer retention service should not be considered as evidence of inadequate service and the basis of a grant of authority; that such a service may not safely be offered and its authorization could lead
