1 plan for abandoned uranium mill sites in those States. Such

2 plan must meet the requirements of section 4 of this Act.

(b) (1) No grant may be made under this section un

4 less an application thereof has been submitted to and ap

5 proved by the Secretary. The Secretary may not approve 6 an application unless

(A) the application contains a site restoration plan which meets the requirements of section 4 of this Act; (B) the application is submitted within three years after the date of the enactment of this Act; and

(C) the application is submitted in such form, and in accordance with such procedures, as the Secretary

may require, including compliance with regulations set forth in section 10 (a).

SEC. 3. (a) The Secretary shall approve or disapprove 16 any application for a grant under this section within one 17 hundred and twenty days after the submission of such appli18 cation to the Secretary, and shall notify the applicant in writ19 ing of the decision. The Secretary shall provide the appli20 cant with a detailed written statement of the reasons for the 21 rejection of any application.

(b) If the Secretary has rejected an application, the ap23 plicant may submit a revised application. The Secretary shall

24 consider such a revised application in accordance with section 25 2(b) (1) of this Act.

(c) Subject to the availability of funds, the Secretary

shall award to any applicant whose application has been ap

3 proved under this section a grant in an amount equal to the 4 costs of carrying out such applicant's site restoration plan, as 5 estimated in such plan pursuant to section 4 (g) of this Act. SEC. 4. The site restoration plan required under section. 7 2(b) (1) shall—

(a) designate the abandoned uranium mill sites (including sites on Federal property) which the applicant intends to restore;

(b) describe the method by which the applicant

12 shall restore the background radiation level at any site

13

designated under subsection (a) of this section to a

level which is no more than twice the background level

which existed before milling operations began at such

site in order to eliminate any health hazard to residents

of the area;

(c) describe the method by which the applicant shall restore offsite uranium mill tailings to the original mill site;

(d) specify the sites which the applicant shall use for the disposal of the uranium mill tailings removed

from the abandoned sites designated under subsection (a) of this section;

(e) indicate the manner in which the applicant

shall dispose of the tailings so as to prevent any further exposure of individuals to radiation emanating from the tailings;

(f) describe the manner in which the applicant, during the fifteen-year period following such disposal, shall monitor the radiation levels at the sites specified

under subsection (d) of this section; and

(g) contain an estimate of the grant required to

carry out the plan.

(1) Such grant shall include—

(A) the cost of contracting services for engineering, removal and stabilization at selected sites, monitoring of remedial action to determine that radiation levels specified in section 4 (b) of this Act have been achieved, and any other direct costs associated with the site restoration.

(B) An amount not to exceed 75 per centum of the cost of offsite restoration referred

to in section 4 (C).

(2) Such grant shall not include

(A) costs associated with development of the site restoration plan, personnel and other administrative costs in administering the plan,

or any indirect costs associated with the site

restoration plan.

(B) Cost of property acquisition referred

to in section 5 of this Act.

SEC. 5. (a) The Secretary shall require any State sub6 mitting a grant application to acquire the land upon which 7 the tailings and abandoned mill site are located prior to the 8 release of any grant funds to the applicant. However, the 9 State shall not be required to acquire ownership of lands 10 which require remedial action as a result of the incidental offsite spread of the uranium mill tailings, or where such 12 tailings were used as offsite construction materials.

(b) The States shall within three years after the com

14 pletion of site restoration either

(1) dispose itself of ownership of the site and remit to the Secretary proceeds from the sale in excess

of the State's acquisition costs;

(2) transfer title for the site to the Secretary; or

(3) pay to the Secretary the difference between the site's then market value and the State's acquisition cost.

SEC. 6. (a) No grant recipient shall make any change

22 in an approved site restoration plan without the approval of

23 the Secretary, or use a grant awarded under section 3 (c)

1 of this Act for any purpose other than carrying out such

2 plan.

(b) If the Secretary determines that any funds awarded 4 to any grant recipient under section 3 (c) of this Act have 5 been used for purposes other than those specified in sub6 section (a) of this section, such grant recipient shall be 7 liable for the repayment of such funds to the Federal Gov8 ernment. The United States may bring a civil action to 9 recover such funds from such grant recipient. The Secretary 10 shall determine whether any additional funds awarded under 11 such subsection shall be paid to such grant recipient.

SEC. 7. (a) The abandoned uranium mill sites referred 13 to in section 2 (a) of this Act include, but shall not be limited 14 to, the following areas: Monument Valley, Arizona; Tuba 15 City, Arizona; Durango, Colorado; Grand Junction, Colorado; 16 Maybelle, Colorado; Naturita, Colorado; Rifle, Colorado; 17 Slick Rock, Colorado; Lowman, Idaho; Ambrosia Lake, 18 New Mexico; Shiprock, New Mexico; Lakeview, Oregon; 19 Cannonsburg, Pennsylvania; Falls City, Texas; Ray Pointe, 20 Texas; Green River, Utah; Mexican Hat, Utah; Salt Lake 21 City, Utah; Riverton, Wyoming; Spook, Wyoming. 22 (b) The Secretary, upon request, shall provide the 23 States specified in section 2 (a) of this Act with such 24 technical assistance as the States may require to prepare a 25 site restoration plan satisfactory to the Secretary.
