This report will be prepared and submitted semiannually to the Judge Advocate General by each officer exercising general court-martial jurisdiction (GCM AUTH). Separate reports will be submitted for Navy personnel and for Marine Corps personnel. Reports will be submitted by each GCM AUTH on 25 January and on 25 July of each year.

Negative reports are required. The Negative Marine Corps Report block may be marked on the report submitted for Navy personnel if there are no Marine Corps statistics to be reported, or the Negative Navy Report block may be marked on the report submitted for Marine Corps personnel if there are no Navy statistics to be reported. Statistics concerning court-martial cases will be obtained from records of trial reviewed by each GCM AUTH. Do not report court-martial cases in which action by the GCM AUTH has not been completed by the end of the reporting period.

Statistics concerning nonjudicial punishments and civil felony convictions will be reported during the period in which the NJP was imposed or the civil conviction occurred. Statistics will be obtained from NAVJAG 5800/9A forms submitted to each GCM AUTH by subordinate activities, and consolidated with any data maintained by the GCM AUTH.

When a GCM AUTH's command is disestablished, that GCM AUTH should report the cases reviewed prior to disestablishment. The GCM AUTH who accepts uncompleted cases from the disestablished command should include those cases (including all processing time) in his own report when review is complete.

When one GCM AUTH sends a case to another GCM AUTH for review because the original GCM AUTH is disqualified from reviewing the case, or for any reason other than disestablishment of the original GCM AUTH's command, the original GCM AUTH should include the case (including all processing time) in his own report when review is complete.

Do not include rehearings in Parts I through X of this form. Statistics as to the original trial should be reported in Parts I through X, but the rehearing should be reported only in Part XI. The original trial will be reported in Parts 1 through X as an acquittal.

A BCD SPCM is a case in which the sentence as approved by the GCM AUTH includes a bad conduct discharge, either suspended or unsuspended... A Non-BCD SPCM is a case in which the sentence as approved by the GCM AUTH does not include a bad conduct discharge, either suspended or unsuspended.

Report in the column headed “Guilty Pleas" those cases where the accused pleaded guilty to ALL charges and specifications, including negotiated plea cases.
The cases reported in the "Negotiated Pleas" column must be included in the cases reported in the "Guilty Pleas" column.

If a trial, after review by the GCM AUTH, resulted in conviction of any offense, it should be reported as a "conviction." If conviction of more than one offense is involved in a particular trial, report only one conviction for that individual's trial.

Report only on drug/marijuana offenses. Do not report on other types of offenses which may have been tried at the same time. The convictions reported under "Total Number Articles" for Non-BCD SPCMs and SCMs must match the total Art. 92.4-134.16 convictions reported for each type of trial under Part IV.

In "Other" under "Military-Type Offenses," indicate the total of military-type offenses which involve articles other than those reported separately in the preceding columns. In "Other" under "Civil-Type Offenses," indicate the total of civil-type offenses which involve articles other than those reported separately in the preceding

columns.

The figures reported in this part concern articles and not cases, and therefore will not match the case totals reported in Part IA.

If any specification of a charge is “afloat-oriented," the charge (article) should be reported as an "Afloat-Oriented Article Tried." Examples of “afloat-oriented" offenses are: (1) offenses which occur on board ship (including embarked units); (2) unauthorized absence or desertion from a ship or embarked unit; (3) missing the movement of a ship or embarked unit, (4) failure to report for duty to a ship or embarked unit, or to a unit scheduled for embarking.

The total articles tried for each type of trial must match the total articles for each type of trial on the "Tried" line in the "Grand Total" column of Part IV.
