02.02 Environmental threshold assessment survey has been prepared by Commission and made available for public inspection upon request; such survey has found that no significant impact on environment would result from approval of instant application; it has been determined that, based on aforesaid threshold assessment survey, no environmental impact statement need be issued in this proceeding as it does not represent major Federal action significantly affecting quality of human environment within meaning of National Environmental Policy Act of 1969; appropriate notice of such determination has been published as directed by Commission; Commission received no substantive comments as to said determination as of date hereof; said threshold assessment survey is part of record in this proceeding and has been weighed in considering issues herein; and benefits of permitting construction and operation of said line outweigh adverse environmental factors. 02.02 Impact statements recognizes number of beneficial impacts which will result from this action. Most obvious is fostering of recycling centers to channel waste products back into manufacturing cycle. Adoption of these rules will have indirect beneficial impact by helping to alleviate litter problem and by providing additional incentive to use recycled materials rather than dependence on limited supplies of virgin resources. Further benefit will be achieved by providing additional traffic obtainable through streamlined certification process in which general finding of public convenience and necessity has already been made. 02.20 Generally

02.2 Interstate and Foreign Commerce

02.20 Although jurisdictional question has not been raised by parties, Commission can exercise only powers conferred upon it by statute. In all controversies before it, if there is lack of jurisdiction, whether from absence of essential facts or through want of power in statute, it is duty of Commission, of its own motion, to deny jurisdiction. 13 I.C.C. 473. Sec. 13 of Act authorizes complaints to Commission and confers jurisdiction to entertain them. 1 I.C.C. 8, 9. However, power of Commission to adjudicate complaints extends only to such acts of omissions of common carriers as are in contravention of provisions of Act. 48 I.C.C. 611, 612. No. 36036, C-G-F- Grain Co., Inc. v. Atchison, T. & S.F. Ry Co., 351 İ.C.C. 710, 712, 3-17-76, Ap. Div. 2.
