BILLS RELATED TO EDUCATION AND TRAINING

PROGRAMS ADMINISTERED BY V.A.

The subcommittee met at 10 a.m., pursuant to call, in room 2318, Rayburn Building, Hon. George E. Brown, Jr. (chairman of the subcommittee) presiding.

Mr. BROWN. The subcommittee will come to order.

We are meeting this morning to consider the bills H.R. 16025, H.R. 14954, and H.R. 14253, all of which relate to the field of education and training. Without objection I will insert at this point in the record the text of the three bills, together with recommendations of the U.S. Veterans' Advisory Commission numbered 30, 31, 65, 66, and 69, which are related to the bills under consideration.

A BILL To amend section 1774 of title 38 of the United States Code to permit State and local agencies to be reimbursed for certain expenses incurred by such agencies in administering educational benefits under chapters 34 and 35 of such title

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 1774 of title 38, United States Code, is amended

(1) by striking out "expenses of salary and travel incurred by employees of such agencies" and inserting in lieu thereof "administrative expenses incurred by such agencies", and

(2) by adding the following new sentence before the last sentence thereof: "For the purposes of this section, the term 'administrative expenses' includes rental, repair, maintenance, utility, and insurance expenses for agency facilities; salary and travel expenses for employees; postage; costs of office equipment and supplies, educational supplies, and freight and delivery services; and any other miscellaneous operating expenses."

SEC. 2. The amendments made by the first section of this Act shall apply with respect to contracts and agreements entered into under section 1774 of such title effective for the periods beginning after June 30, 1968.

A BILL To amend title 38 of the United States Code to improve vocational rehabilitation training for service-connected veterans by authorizing pursuit of such training on a part-time basis

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 1504 of title 38, United States Code, is amended by (1) deleting in subsection (b) the table contained therein in its entirety and substituting in lieu thereof the following:

and (2) inserting in the first sentence following the table immediately before the word "trainee" the following: "full-time"; and (3) by inserting at the end of such section immediately after subsection (c) the following new subsection: "d) The Administrator shall define full-time and part-time training in the case of all eligible veterans pursuing a course of vocational rehabilitation training under this chapter."

A BILL To amend title 38 of the United States Code with respect to compensation and educational assistance for widows of veterans, to make certain widows and children eligible for care in Veterans' Administration hospitals, and to change the limitation on the periods of educational assistance available under part III of such title

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) section 103 (d) of title 38, United States Code, is amended by inserting “(1)” immediately before "The remarriage", and by adding at the end thereof the following new paragraph:

"(2) Where the death of a veteran has qualified his widow for benefits under chapter 13 of this title, her remarriage shall terminate her entitlement thereto; except that if the remarriage terminates by death, or by divorce without fault on her part, and she is not eligible for benefits under such chapter as the widow or the person whom she has remarried, then her eligibility for such benefits, as the widow of the first veteran, shall be restored effective as of the date of termination of the remarriage."

(b) Paragraph (3) of section 101 of such title is amended by inserting immediately after "who has not remarried" the following: "(except in cases provided for under section 101 (d) (2) of this title)".

SEC. 2. Paragraph (1) of subsection (a) of section 610 of title 38, United States Code, is amended by striking out "or" at the end of subparagraph (A), by inserting "or" at the end of subparagraph (B), and by adding at the end thereof the following:

"(C) the widow of a veteran of any period of war or the child of a deceased veteran of any such period if such widow or child is unable to defray the expenses of such necessary hospital care;".

SEC. 3. (a) Subsection (b) of section 1661 of title 38, United States Code, is amended by striking out "(3)" and all that follows through the end thereof and inserting in lieu thereof the following: "(3) chapter 33 of this title, as in effect before February 1, 1965."

(b) Section 1711 of title 38, United States Code, is amended by striking out subsection (b) and redesignating subsections (c) and (d) as subsections (b) and (c), respectively.

(e) (1) Subchapter II of chapter 36 of title 38, United States Code, is amended by adding at the end thereof the following new section:

"S 1791. Limitation on period of assistance under two or more programs

"The aggregate period for which any person may receive assistance under two or more of the preceding chapters of this part may not exceed forty-eight months (or the part-time equivalent thereof), but this section shall not be deemed to limit the period for which assistance may be received under chapter 31 alone."

(2) The table of sections of chapter 36 of title 38, United States Code, is amended by adding at the end thereof the following:

"1791. Limitation on period of assistance under two or more programs.".

EDUCATION AND TRAINING PROGRAM

SEC. 4. (a) The first sentence of section 1701 (a) (1) of title 38, United States Code, is amended to read as follows:

"(1) The term 'eligible person' means

or

"(A) a child of a person who

"(i) died of a service-connected disability, or

"(ii) has a total disability permanent in nature resulting from a service-connected disability, or who died while a disability so evaluated was in existence;

(B) the widow of any person who died of a service-connected disability;

(C) the wife of any person who has a total disability permanent in nature resulting from a service-connected disability; arising out of active military, naval, or air service after the beginning of the Spanish-American War, but only if such service did not terminate under dishonorable conditions. The standards and criteria for determining whether or not a disability arising out of such service is service-connected shall be those applicable under chapter 11 of this title."

(b) Subsection (d) of section 1701 of title 38, United States Code, is amended (1) by inserting "(1)" immediately after "for the purpose of providing opportunities for education" and (2) by inserting immediately before the period at the end thereof the following: "and (2) to widows of men who die or have died from such a disease or injury to assist such widows in preparing to support themselves and their children more nearly in the manner which would have been possible but for the death of their spouses".

(c) Section 1712 (a) of title 38, United States Code, is amended by inserting immediately after "eligible person" the first place where it appears the following: "(within the meaning of section 1701 (a) (1) (A))”.

(d) (1) The first sentence of section 1713 of title 38, United States Code, is amended by inserting immediately after "is sought under this chapter" the following: "or the widow of a person who died of a service-connected disability who is seeking educational assistance under this chapter".

(2) The third sentence of such section 1713 is amended by striking out "parent or guardian" and inserting in lieu thereof "eligible person, parent, or guardian, as appropriate,”.

(e) Section 1714 (a) of title 38, United States Code, is amended by inserting immediately after "eligible person" the following: ", in the case of an eligible person within the meaning of section 1701 (a) (1) (A), or the eligible person herself requests special restorative training, in the case of an eligible person within the meaning of section 1701 (a) (1) (B)".

(f) (1) The first sentence of section 1720 of title 38, United States Code, is amended by inserting immediately after "eligible person" the second place where it appears the following: ", or the eligible person, as the case may be.".

(2) The second sentence of such section 1720 is amended by inserting immediately after "eligible person" the following: "or the eligible person shall prepare for herself, as the case may be.".

(3) The third sentence of such section is amended by inserting immediately after "parent or guardian" the following: "for an eligible person within the meaning of section 1701(a)(1)(A) or by the eligible person herself in any other case".

(g) Section 1722 of title 38, United States Code, is amended by inserting immediately after "parent or guardian" the following: "in the case of an eligible person within the meaning of section 1701 (a) (1) (A)”.

(h) (1) Subsection (a) of section 1731 of title 38, United States Code, is amended (A) by inserting immediately after "eligible person" the first place where it appears the following: "within the meaning of section 1701 (a) (1) (A)" and (B) by inserting immediately after "eligible person." the following: "and to each eligible person within the meaning of section 1701 (a) (1) (B) who is pursuing a program of education under this chapter.".

(2) Subsection (b) of such section and section 1732 of such title are amended by inserting "to or" immediately before "on behalf of" each place where it appears therein.

(1) Subsection (a) of section 1741 of title 38, United States Code, is amended by inserting "or of the eligible person himself" immediately after "eligible person." (j) (1) The first sentence of subsection (a) of section 1742 of title 38, United States Code, is amended by striking out "parent or guardian shall be entitled to receive" and inserting in lieu thereof "eligible person, parent, or guardian, as the case may be, shall be entitled to receive or receive".
