Currently, the President exercises his authority through the Director of the Office of Emergency Planning (OEP), the Director of Telecommunications Management (DTM) (who is also an Assistant Director, OEP), and the IRAC. This arrangement was established by Executive Order 10995 of February 16, 1962 (27 F.R. 1519, Feb. 20, 1962), creating the position of DTM and delegating the authority under section 305 to the Director, OEP, with permission to redelegate it to the DTM. This authority was redelegated, effective February 16, 1962, to the DTM by OEP order (27 F.R. 1864, Feb. 27, 1962). The IRAC was authorized by OEP order, pending appointment and qualification of the DTM and action by him in the premises, to report to the Director of Telecommunications, OEP, and subject to his approval, to assign frequencies to Government radio stations on an interim basis (27 F.R. 1864, Feb. 27, 1962). (Attachments 3 and 4.) Between June 1934 and February 1962, the IRAC was chaired and reported to the President or his designee as follows:

March 29, 1927 to November 8, 1935:

During the existence of the Board of War Communications (BWC)— originally the Defense Communications Board (DCB)-September 20, 1940, to February 24, 1947, the IRAC reported to the BWC on certain matters and as Committee V advised on frequency matters involving Government stations. April 1, 1941, to October 8, 1951:

Chairman: IRAC agency representative, alphabetically by agency, starting with Commerce. (See attachment 2.)

Reported to: The President through the Chairman, FCC, and the BWC until February 24, 1947.

November 9, 1951, to June 15, 1953:

Chairman: Agency representative until October 6, 1952, at which time the Telecommunications Adviser to the President (TAP) appointed a permanent chairman from his staff.

Reported to: The Telecommunications Adviser to the President, established by Executive Order 10297 of October 9, 1951.

June 16, 1953, to June 30, 1958:

Chairman: Official of the Office of Defense Mobbilization (ODM).

Reported to: Director, ODM, through the Assistant Director of Telecommunications.

Executive Order 10460 of June 16, 1953, abolished the position of Telecommunications Adviser to the President and transferred the functions to the Director, ODM.

July 1, 1958, to January 22, 1961:

Chairman: Official of the Office of Civil and Defense Mobilization (OCDM), Telecommunications.

Reported to: Director, OCDM, through the Assistant Director for Resources and Production, and the Deputy Assistant Director for Telecommunications, under Executive Order 10460, as amended by Executive Order 10773 of July 1, 1958.

January 23, 1961, to September 22, 1961:

September 23, 1961. to February 15, 1962:

Section 606-War powers of the President over telecommunications

The President has exercised his war powers over telecommunications only once since the enactment of the Communications Act of 1934, as amended. This was during World War II.

Executive Order 8546 created the Defense Communications Board (DCB) (name changed to Board of War Communications (BWC) by Executive Order 9183 of January 15, 1942), to coordinate the relationship of all branches of communication to the national defense. The Board was composed of the Chairman, FCC, as Chairman, the Chief Signal Officer of the Army, the Director of Naval Communications, the Assistant Secretary of State in charge of the Division of International Communications, and the Assistant Secretary of the Treasury in charge of the Coast Guard. During a war in which the United States was a belligerent, or any national emergency, the IRAC was to act as a committee of the Board (Committee V) but in an advisory capacity.

Executive Order 9831 of February 24, 1947, abolished the Board of War Communications.

Following the Korean action, the President has delegated authority for planning only under his powers stemming from section 606. These delegations are: December 10, 1951: Executive Order 10312 providing for emergency control over certain Government and non-Government stations engaged in radio communication or radio transmission of energy (conelrad) was issued. Responsibility for review of and concurrence in plans prior to their implementation was assigned to the Secretary of Defense and the Chairman of the National Security Resources Board (later changed to Director, Office of Defense Mobilization; Director, Office of Civil and Defense Mobilization; and Director, Office of Emergency Planning). This order involved planning under the President's emergency authority pursuant to subsection 606 (c) of the Communication Act of 1934, as amended.

April 17, 1957: Executive Order 10705 delegated to the Director, Office of Civil and Defense Mobilization (later changed to Office of Emergency Planning), the authority vested in the President by subsections 606 (a), (c), and (d), of the Communications Act of 1934, as amended. The delegation was effective immediately for planning but was contingent upon possible proclamation by the President with respect to the exercise of the authority.

This authority was authorized by Executive Order 10995 to be redelegated to the Director of Telecommunications Management. It was redelegated by OEP order effective February 16, 1962 (27 F.R. 1864, Feb. 27, 1962). (See attachments 3 and 4.)

The planning under this authority is carried on by the Telecommunications Office, OEP, under the direction of the DTM.
